1.1 — I reserve the right to refuse any commission request for any reason without explanation.

1.2 — By purchasing a commission, the Client confirms they are 18 years or older OR have permission from a parent/guardian to make online purchases.

1.3 — The Client is expected to read and understand these Terms of Service before purchasing artwork.

1.4 — Any violation of these Terms may result in cancellation, blacklisting, or refusal of future service.

2.1 — Commissions may be requested through:

• Email
• Discord
• Artistree / VGen / Ko-fi
• Official commission forms

2.2 — The Client must provide clear references and descriptions before work begins.

2.3 — The Artist is not responsible for inaccuracies caused by missing, unclear, or changing references.

2.4 — Major design changes after work has started may result in additional charges.

2.5 — The Artist reserves the right to stream, post, or publicly showcase commissioned artwork unless otherwise agreed upon beforehand.

3.1 — All prices are listed in CAD/USD unless stated otherwise.

3.2 — Payment is accepted through approved payment platforms only.

3.3 — Payment methods may include:

• PayPal
• E-transfer
• Ko-fi
• Artistree / VGen invoices

3.4 — Full payment upfront is required for most commissions unless otherwise discussed.

3.5 — For larger projects, payment plans or split payments may be offered at the Artist's discretion.

3.6 — Work will not begin until payment has been received.

3.7 — Clients may not issue chargebacks after receiving completed artwork.

• Immediate blacklisting
• Revocation of usage rights
• Public commissioner warning if necessary

4.1 — Refunds are dependent on the stage of completion.

4.2 — If the commission has not been started, the Client may receive a full refund.

4.3 — If work has already begun, only a partial refund may be issued based on completed progress.

4.4 — No refunds will be given after the artwork is completed and delivered.

5.1 — Estimated turnaround times vary depending on commission complexity, queue size, health, workload, and real-life responsibilities.

5.2 — Average turnaround may range from several days to multiple weeks.

5.3 — The Artist will communicate major delays whenever possible.

5.4 — Rush orders may incur additional fees.

5.5 — Harassment, spam, or excessive demands for updates may result in cancellation without refund.

6.1 — Clients may request reasonable revisions during the sketch phase.

6.2 — Minor revisions after rendering has begun may be allowed at the Artist's discretion.

6.3 — Major revisions after approval of sketches may require additional payment.

Examples of major revisions include:

• Changing the pose
• Changing the outfit
• Redesigning the character
• Altering composition significantly

6.4 — Excessive revisions may be refused.

7.1 — The Artist retains full copyright ownership of all artwork unless explicitly transferred in writing.

7.2 — Purchasing artwork does NOT transfer copyright ownership.

7.3 — The Client may:

• ✔ Use commissioned artwork for personal use
• ✔ Upload/post artwork with proper credit
• ✔ Use artwork for profile pictures, banners, wallpapers, and personal pages

7.4 — The Client may NOT:

• ✘ Claim the artwork as their own
• ✘ Remove watermarks or signatures
• ✘ Edit or heavily alter artwork without permission
• ✘ Mint or sell the artwork as NFTs
• ✘ Use artwork for AI training, datasets, or machine learning
• ✘ Redistribute, reproduce, or resell artwork commercially unless commercial rights were purchased

8.1 — Any use intended to generate profit is considered commercial use.

Commercial use includes but is not limited to:

• Merchandise
• Branding
• Stream assets
• VTuber assets
• Advertising
• Promotional materials
• Monetized content

8.2 — Commercial rights are NOT included in standard commission pricing unless explicitly stated.

8.3 — Commercial projects require additional licensing fees.

8.4 — The Artist retains the right to refuse commercial projects.

9.1 — Ownership of adopts/designs transfers to the buyer after full payment.

9.2 — The Artist retains the right to:

• Display the design in portfolios
• Use the design for promotional purposes
• Credit themselves as the original designer

9.3 — Buyers may:

• ✔ Rename the character
• ✔ Redesign outfits, hair, and details
• ✔ Use the character for roleplay or personal stories

9.4 — Buyers may NOT:

• ✘ Claim original design authorship
• ✘ Resell the design for more than its original value without additional commissioned artwork attached
• ✘ Use the design for NFTs or AI-related purposes

9.5 — Co-ownership, shared payments, or payment plans for adopts are handled at the Artist's discretion.

10.1 — YCH commissions use pre-made poses/compositions created by the Artist.

10.2 — Only the character featured within the YCH template will be customized unless otherwise stated.

10.3 — Turnaround times for YCH commissions may be faster than fully custom commissions.

11.1 — Harassment, inappropriate behavior, manipulation, discrimination, or repeated disrespect will not be tolerated.

11.2 — The Artist reserves the right to refuse or cancel service to any Client behaving inappropriately.

11.3 — Clients are expected to communicate respectfully and professionally.

12.1 — The Artist reserves the right to decline subject matter they are uncomfortable drawing.

12.2 — The following content may be refused:

• Hate speech
• Illegal content
• Extreme NSFW/fetish content
• Offensive or discriminatory themes
• Heavy mecha
• Explicit gore
• Anything involving minors in NSFW situations

By commissioning the Artist, the Client confirms they have:

• Read these Terms of Service
• Understood these Terms of Service
• Agreed to all conditions stated above

Violation of these Terms may result in revoked usage rights, cancellation, or blacklisting from future commissions.
